User & Chef Content Policy for Customers, Chefs and Delivery Partners

The rules for content you share on Thuiskook, reviews, photos, messages and more, what you keep, what you let us do with it, and what is not allowed.

About this policy

In short

Thuiskook is a community for real home-cooked food. This policy covers the content you share with us and with other people on the Platform, reviews and ratings, photos and dish descriptions, messages, support requests, and entries to competitions or promotions (together, “User & Chef Content”).

The deal is simple: your content stays yours. You give us a limited licence to show and promote it as part of running the Platform, you promise it’s yours to share, and you agree not to post things that are unlawful, abusive or harmful. We can remove content that breaks these rules, and if we do, we will tell you why and you can challenge it.

This policy forms part of, and should be read with, the Thuiskook General Terms and Conditions and, for Chefs, the Chef Agreement. If something here conflicts with those documents, those documents control.

Who this applies to

This policy applies to everyone who submits content through the Platform, Customers, Chefs and Delivery Partners, referred to here as “you”. “Thuiskook”, “we” or “us” means Thuiskook B.V., registered in the Netherlands with the Chamber of Commerce under KvK no. [____], with its registered office at [address], [postal code] [city], the Netherlands.

1. What counts as User & Chef Content

1.1 From time to time the Platform lets you submit, upload, publish or otherwise make available text, images, audio and other materials. This includes reviews and ratings, comments and feedback, dish photographs and descriptions, profile and biography information, messages sent through the Platform, support requests, and entries to competitions or promotions. We call all of this “User & Chef Content”.

1.2 Some content is public by its nature. Reviews, ratings, Chef profiles, dish photos and dish descriptions can be seen by other people using the Platform. Treat anything you post as potentially public, and do not include private information you would not want others to see.

2. Ownership and the licence you grant us

2.1 You keep ownership. The User & Chef Content you provide remains yours. Chefs keep ownership of their recipes and know-how; nothing in this policy transfers your underlying rights to Thuiskook.

2.2 The licence you grant. By providing User & Chef Content, you grant Thuiskook a non-exclusive, royalty-free, worldwide licence to use, store, copy, adapt for formatting (including resizing, cropping, captioning and translating for the Platform), display, distribute and otherwise make available that content for the purpose of operating, providing and promoting the Platform, including on the Platform itself, in app stores, and in Thuiskook’s marketing on social media, its website and printed materials.

2.3 How long it lasts. This licence runs for as long as you keep the content on the Platform and for a reasonable period afterwards to the extent needed for Thuiskook’s ordinary operational and promotional use. For Chefs, the specific licence terms and any post-termination period set out in the Chef Agreement apply to Chef content. Customer reviews are licensed as set out in the General Terms and Conditions.

2.4 Sublicensing. Thuiskook may allow its service providers (for example, hosting or marketing partners) to use the content only as needed to deliver those services to Thuiskook, on terms consistent with this policy. Thuiskook does not claim a perpetual or irrevocable right to your content, and does not sell your content to unrelated third parties for their own advertising.

2.5 Removal. You can remove or request removal of content you have posted, subject to the rest of this policy and to Thuiskook’s need to keep records where required by law. Removing content ends the forward-looking licence, except for copies already made for legitimate operational reasons (such as backups) and uses that cannot reasonably be reversed (such as material already printed or distributed).

2.6 Termination of your account. If your account is terminated, the licence in this Section ends on the same basis as removal under Section 2.5, except where a longer period is expressly set out in the Chef Agreement or General Terms and Conditions, or where retention is required by law.

2.7 Feedback and suggestions. If you send us ideas, suggestions or feedback about Thuiskook or how to improve the Platform (as distinct from content you post for other users), you agree we may use them freely, without restriction and without any obligation or payment to you. This does not give us any rights in a Chef’s recipes or know-how under Section 2.1.

3. Your promises about the content you share

Each time you submit User & Chef Content, you represent and warrant that:

  • you either own all of it, or hold all the rights, licences, consents and releases needed to grant the licence in Section 2;
  • the content, your sharing of it, and Thuiskook’s permitted use of it will not infringe or misappropriate anyone else’s intellectual property, privacy or publicity rights;
  • any photographs reasonably represent what they claim to show, for Chefs, dish photos should reasonably represent the actual dish, and you must not use misleading, stock or third-party images of dishes you do not prepare;
  • any AI-generated, edited or composited image is not presented as a genuine photograph of a dish you prepare, and you will disclose where an image is not a real photograph if asked; and
  • the content does not break any applicable law or this policy, and does not include another person’s personal data without a proper basis. You are responsible for the content you share. Thuiskook does not pre-screen all content, does not endorse or approve it, and does not accept responsibility for content posted by users beyond its own role as operator of the Platform. Where the General Terms and Conditions include an indemnity for third-party claims arising from your content, that indemnity applies to this policy.

4. What you may not do

When you access or use the Platform, you agree that you will not:

  • break any applicable law, rule or regulation;
  • post content that is unlawful, abusive, harassing, threatening, hateful or discriminatory, hate speech is not tolerated;
  • post content that is defamatory, obscene, sexually explicit, profane, vulgar, indecent or otherwise reasonably objectionable;
  • post content you do not have the right to share, or that infringes someone’s intellectual property, privacy or other rights;
  • publish another person’s personal information without a proper basis, or attempt to obtain or ‘phish’ for someone else’s password, account or private information;
  • advertise or offer regulated or prohibited goods through your content or listings, for example alcohol, tobacco, controlled substances, unpasteurised or otherwise restricted food products, or supplements, unless you hold every permission and licence the law requires and Thuiskook has approved it;
  • use the Platform’s messaging or content tools for anything other than communication related to an Order, no advertising, spam, chain letters, pyramid schemes or other solicitation;
  • impersonate any person, or falsely imply that you are a Thuiskook employee, partner or representative;
  • misuse in-app support or complaint functions, or make false reports to Thuiskook staff;
  • manipulate reviews or ratings, including posting reviews of your own Chef business, soliciting or incentivising reviews, or posting fake or coordinated reviews;
  • interfere with or disrupt the Platform or its servers or networks, including any hacking, or upload malicious code such as viruses, worms, Trojan horses, spyware, corrupted files or denial-of-service attacks;
  • use any robot, spider, scraper or other automated means to access the Platform or copy its content without authorisation;
  • access the Platform through any service not controlled or authorised by Thuiskook; or
  • promote, encourage or take part in any of the above.

5. Food-safety, allergens and dish accuracy

5.1 Because Thuiskook is a marketplace for food, content that describes a dish must be accurate. Dish descriptions, ingredient lists and any allergen information must be truthful, current and not misleading.

5.2 Chefs are responsible for the accuracy of the allergen and ingredient information in their content and must declare the major allergens present in a dish in line with applicable food-information law. Chefs must not omit or downplay allergens, and must update their content if a recipe changes.

5.3 Content must not give unsafe food-handling or health advice, or make medical or health claims about a dish that cannot be substantiated. This Section sits alongside the food-safety duties in the General Terms and Conditions and the Chef Agreement, and the food-safety incident handling described in the Privacy Policy.

6. Reviews, ratings and messaging

6.1 Reviews and ratings must be truthful, fair and based on your own genuine experience of an Order. They must not be defamatory, abusive, discriminatory or unlawful, and must not contain the personal data of third parties.

6.2 Chefs may respond to reviews professionally and respectfully and must not disclose a Customer’s personal information. Chefs may not post their own reviews, solicit positive reviews, or offer anything in exchange for a review.

6.3 Messaging on the Platform is for fulfilling an Order and reasonable follow-up. Contact details and messages obtained through the Platform must not be used for off-platform marketing or solicitation, and are subject to the Privacy Policy and the data-protection terms in the General Terms and Conditions.

7. Intellectual property complaints and repeat infringers

7.1 If you believe content on the Platform infringes your copyright, trademark or other intellectual-property rights, you can notify us at hello@thuiskook.com. Please identify yourself, the right you hold, the content concerned and where it appears, and confirm that your complaint is made in good faith.

7.2 We will review valid complaints and may remove or disable the content concerned. Where we remove content following a complaint, we will tell the person who posted it and give them an opportunity to respond; if they provide a good-faith justification for the content, we may reinstate it.

7.3 Thuiskook may suspend or terminate the account of anyone who repeatedly infringes the intellectual-property rights of others.

8. Moderation, removal and monitoring

8.1 Thuiskook may, acting reasonably and objectively and in line with a published moderation approach, remove, edit, hide or disable any User & Chef Content that it determines breaches this policy or any applicable law, or is otherwise reasonably objectionable. Thuiskook does not assume liability for removing content, for not removing it, or for content posted by users.

8.2 Thuiskook may monitor or record activity and content on the Platform to the extent permitted by law, for example to keep the community safe, detect fraud and abuse, and improve the service. Any such monitoring is carried out in accordance with the Privacy Policy.

9. Notice and action, statement of reasons, and appeals

9.1 Reporting illegal content. Anyone can notify us of content they consider illegal by emailing hello@thuiskook.com (and, where available, the in-app report function). A notice should explain why the content is illegal, identify where it is, and include the notifier’s contact details (unless it concerns certain offences against children). We will confirm receipt where you give us your contact details, and review and act on notices in a timely, diligent and objective way.

9.2 Statement of reasons. Where we remove, disable, demote or otherwise restrict your content, or restrict or suspend your account, because of this policy or applicable law, we will give you a clear statement of reasons, what we did, why, the legal or policy ground we relied on, whether automated means were used, and how you can challenge the decision, unless the law prevents us from doing so (for example where notifying you would prejudice a criminal investigation).

9.3 Internal complaint handling. If you disagree with a decision, you may challenge it free of charge by contacting us at hello@thuiskook.com, normally within six months of being told. We will review your complaint without undue delay, under human supervision rather than automated means alone, and will reverse our decision where it was wrong.

9.4 Out-of-court dispute settlement and other rights. If you are not satisfied with the outcome, you may be entitled to use a certified out-of-court dispute-settlement body, and you retain the right to go to court. Nothing in this policy limits any rights you have under applicable law, including the EU Digital Services Act.

10. Enforcement

10.1 If you, or someone using your account, breaches this policy and does not put it right after a warning, Thuiskook may take action including removing content, restricting features, suspending or revoking access to some or all of the Platform, or terminating your account.

10.2 For serious breaches, for example, illegal content, hate speech, threats, fraud, child-safety risks, or a credible safety risk, Thuiskook may act immediately and without a prior warning. Where practical, Thuiskook will let you know what action it is taking and why, and the appeal rights in Section 9 apply. This Section is in addition to the suspension and termination rights in the General Terms and Conditions and any Chef Agreement.

11. Protecting minors

11.1 The Platform is not intended for anyone under 16, and content must not target, exploit or endanger children.

11.2 Content that sexualises a minor, or any child sexual abuse material, is strictly prohibited. We remove such content, terminate the accounts involved, and report it to the relevant authorities as the law requires. If you become aware of any such content, report it immediately at hello@thuiskook.com.

12. Reporting content

12.1 If you come across content or behaviour that breaks these rules, please tell us so we can look into it. You can report content by emailing hello@thuiskook.com (and, where available, the in-app report function). Reports are reviewed and handled in good faith; please do not misuse the reporting tools.

13. Content removal and your data-protection rights

13.1 Removing content under this policy is not the same as exercising your data-protection rights. If you want to access, correct or delete the personal data we hold about you, rather than simply take down a piece of content, those requests are handled under the Privacy Policy and the GDPR. Where a request affects both, we will deal with the content under this policy and the personal data under the Privacy Policy.

14. Service-specific rules and changes

14.1 Particular features of the Platform may post additional rules that apply to content or conduct on those features. Where they do, those rules apply in addition to this policy.

14.2 Thuiskook may update this policy from time to time. The updated policy will be published on the Platform and the “Last Updated” date revised. Continued use of the Platform after an update takes effect constitutes acceptance of the updated policy.
